§ 1 Scope
(1) These Terms and Conditions (hereinafter "T&Cs") apply to all contracts concluded through the online shop at goldshop.com between the operator of goldshop.com (hereinafter "GOLD SHOP", "we") and the purchaser (hereinafter "you", "the customer"). Our product range covers items from the home and garden categories.
(2) A consumer for the purposes of these terms is any natural person entering into a legal transaction for purposes that fall predominantly outside their trade, business or profession (§ 13 BGB). A trader, by contrast, is a natural or legal person, or a partnership with legal capacity, who in concluding the transaction is acting in the course of their commercial or self-employed professional activity (§ 14 BGB).
(3) Any deviating, contradictory or supplementary terms put forward by the customer shall not form part of the contract unless their validity has been expressly recognised by us in text form.
§ 2 Contracting Party
The purchase contract is concluded between you and the operator of GOLD SHOP. Full provider details can be found in our Legal Notice.

§ 3 Formation of Contract
(1) The display of our home and garden products in the online shop does not, from a legal standpoint, constitute a binding offer, but rather serves as a non-binding online catalogue.
(2) By clicking the "Buy" / "Order now" / "Order with obligation to pay" button, you make a binding offer to purchase the items contained in your basket.
(3) Confirmation of receipt of your order is provided at the same time as its acceptance — you will receive this immediately after submitting your order in the form of an automatically generated email. The dispatch of this confirmation email legally completes the formation of the purchase contract.
(4) We store the contract text and send it to you, together with the T&Cs, by email. The current version of the T&Cs is also available for viewing at any time at goldshop.com/terms.
(5) The contract is concluded in English.
§ 4 Prices and Shipping Charges
(1) All prices displayed on the website are inclusive of the applicable statutory VAT. Any additional shipping and delivery charges will be shown separately during the order process.
(2) For shipments to countries outside the European Union or the United Kingdom, additional customs duties, taxes and other charges may apply. These are payable by the customer.

§ 5 Payment Terms
(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, SOFORT bank transfer, Apple Pay and Google Pay. We reserve the right not to accept individual payment methods on a case-by-case basis.
(2) The purchase price is due for payment upon conclusion of the contract.
(3) If you choose credit card or PayPal as your payment method, your account will be charged immediately upon completion of the order.
§ 6 Delivery
(1) Delivery is made to the shipping address provided by the customer. The relevant delivery times are clearly shown both on the respective product page and during the order process.
(2) Should delivery not be successful after three attempts, we reserve the right to withdraw from the contract. Any payments already made will be refunded to you without delay.
(3) In the event of delays caused by force majeure, the delivery period shall be extended accordingly. We will keep you informed of any such delays in good time.
§ 7 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
§ 8 Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal in accordance with the applicable provisions. A detailed cancellation policy together with a model withdrawal form can be found on our Cancellation Policy page.
§ 9 Warranty and Liability for Defects
(1) The statutory provisions on liability for defects shall apply. For consumers, the limitation period for claims arising from defects is two years from the date of delivery.
(2) For used goods, the limitation period is reduced to one year from the date of delivery.

§ 10 Liability
(1) We accept unlimited liability in cases of intent and gross negligence as well as within the scope of the Product Liability Act.
(2) In cases of slight negligence, we shall only be liable for the breach of a material contractual obligation (so-called cardinal obligation), the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. In such cases, liability shall be limited in amount to the foreseeable damage typical of the contract.
(3) This shall not affect our liability for injury to life, body or health.
§ 11 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr.
(2) We do not participate in dispute resolution proceedings before a consumer arbitration body, neither voluntarily nor are we legally obliged to do so.
§ 12 Applicable Law and Jurisdiction
(1) The contractual relationship shall be governed exclusively by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. As regards consumers, this choice of law shall only apply to the extent that the protection granted by mandatory provisions of the law of the consumer's habitual residence is not thereby withdrawn.
(2) If the customer is a merchant, a legal person under public law or a special fund under public law, our registered office shall be the place of jurisdiction for all disputes arising from the contractual relationship.
§ 13 Final Provisions
Should individual clauses of these T&Cs be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. In place of an invalid provision, the relevant statutory regulation shall apply.
